Assured Programme (Six Months Pan India Roadside Assistance) - Terms & Conditions


These terms and conditions of Assured Programme - Six Months Pan India Roadside Assistance (“RSA Services”) (hereinafter referred to as “Terms and Conditions”) is an electronic record in the form of electronic contract in terms of Information Technology Act, 2000 (as amended from time to time) and rules framed thereunder. Further, this electronic record is generated by a computer system and does not require any physical or digital signature or seal.

“Company” means Girnarsoft Automobiles Private Limited, a company incorporated under the provisions of the Companies Act, 1956, having its registered office at “GIRNAR” 21, Govind Marg, Moti Doongari Road, Dharam Singh Circle, Jaipur-302004, Rajasthan (hereinafter referred to as “Company”, which term may include, as the context may require, its affiliates, successors and assigns). Customer acknowledges that Company and its affiliates own and operate several online auto classified services portals including without limitation www.gaadi.com, www.cardekho.com and mobile applications thereof (collectively referred to as “Portals”).

“Customer” means any individual / firm / proprietorship / company etc. competent to enter into contract as per the Indian Contract Act, 1872 and which expression shall, unless it be repugnant to the context or meaning thereof, be deemed to mean and include its successors, affiliates, legal representatives, administrators and permitted assigns (in case of company) or his/her legal heirs, representatives executors, administrators, successors and permitted assigns (in case of individual) or the partners or partners for the time being of the firm and the survivor or survivors of them and legal heirs, representatives executors or administrators of such partners or survivors (in case of partnership).

“Dealer” means any person or entity engaged in sale and purchase of used/pre-owned motor vehicles and rendering certain allied services to various customers and is registered with and authorized by Company, subject to applicable terms and conditions.

“Assured Certified Cars” means such used/pre-owned motor vehicles, which are certified by the Company and bears a valid Assured certified tag and listed for sale by Dealer on the Portals under Assured Classified Section.

These Terms & Conditions apply to Assured Certified Cars purchased by Customers from Dealer under the Assured Programme as offered by the Company, accompanied by ‘Six Months Pan India Roadside Assistance Certificate’. Under RSA Services, every Assured Certified Car will be covered with requisite roadside assistance in case of breakdown pan India, subject to following Terms and Conditions:

PERIOD OF COVERAGE

Six Months Pan India Roadside Assistance Certificate will be valid for a period of six (6) months from the date of purchase of Assured Certified Car by Customer from respective Dealer.

  • b. Customer can also contact the authorized Dealers to avail RSA Services.

TERMS AND CONDITIONS

  • a. The scope of RSA Services covers only the following:
    •       

      1) Flat tyre assistance, battery jump start, minor mechanical & electrical on road assistance, accidental towing assistance, mechanical or electrical breakdown assistance, wreckage and vehicle retrieval tow assistance.

    •       

      2) No. of RSA Service Call Out- 5

    •       3) Tow Service Call out- 1
    •       4) RSA Coverage - 50 KM from nearest City Centre
    •       5) Tow Coverage - 50 KM, Garage to Garage
    •       6) Additional KM rates for Under Lift Tow Van@ Rs. 15/- Per KM. Rates will be applicable if the tow exceeds stipulated 50 KM.
  • b. KM will be calculated on Garage-to-Garage basis.
  • c. Toll rates will be based on actuals and payable by the Customer.
  • d. Tax such as Green Tax will be additional and payable by the Customer at the time of pick up itself.
  • e. Customer agrees that roadside assistance cannot be availed for services other than listed above.
  • f. Company reserves the right to impose charges on any additional support provided which are outside the coverage of RSA Services.
  • g. Time shall not be of essence here as RSA Services may be affected by multiple factors beyond our control. Company shall not be responsible or liable in any manner for any losses or damages arising out of delays, inability, loss of use etc.

OTHER TERMS

  • a. Company reserves the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change/cancel or vary these Terms & Conditions at its sole discretion.
  • b. These Terms and Conditions shall always be binding on the Customer.
  • c. Customer agrees to provide Six Months Pan India Roadside Assistance Certificate to Company’s and/or Dealer representative(s) at the time of availing RSA Services or as and when required by Company/Dealer.
  • d. The responsibility to provide complete, authentic & valid documentation and information, as required for availing RSA Services, is sole responsibility of the Customer. Customer understands and agrees that Company and/or Dealer shall be at liberty to refuse, without any responsibility or liability in any manner, provision of RSA services in case of inability/refusal to submit complete/correct documentation and/or information, as per satisfaction of Company.
  • e. Customer agrees that provision of RSA Services is only on commercially reasonable and best effort basis and subject to arrangements with third party service providers and various other factors beyond control of Company/Dealer, to support Customer in an event of a breakdown of Assured Certified Car and strictly as per the mentioned scope. Company shall not be responsible or liable in any manner for any events or circumstances beyond the mentioned scope or inability to provide RSA Services for reasons not attributable to Company.
  • f. The decision of Company with regard to applicability of RSA Services in relation to a particular vehicle and/or Customer shall be final, binding and non-challengeable.
  • g. All disputes relating to or arising out of these Terms and Conditions shall be subject to laws of India and the courts of Jaipur, Rajasthan India shall have exclusive jurisdiction. Customer understands and agrees that Assured Certified Cars has been purchased by Customer from Dealer and it is clarified that in the event of any dispute, Customers sole and exclusive remedy shall be against Dealer for concerning Assured Certified Car and related RSA Services. Company’s role is solely limited to facilitate provision of RSA Services through the Dealer, as per Terms and Conditions.
  • h. If any terms of this Terms and Conditions conflict with any other terms and conditions/document/electronic record, this Terms and Conditions shall prevail and supersede, to the extent of such conflict or inconsistency.


Assured Programme (Third-Party Insurance) - Terms & Conditions


These terms and conditions of Assured Programme - Third-Party Insurance (“Insurance Services”) (hereinafter referred to as “Terms and Conditions”) is an electronic record in the form of electronic contract in terms of Information Technology Act, 2000 (as amended from time to time) and rules framed thereunder. Further, this electronic record is generated by a computer system and does not require any physical or digital signature or seal.

“Company” means Girnarsoft Automobiles Private Limited, a company incorporated under the provisions of the Companies Act, 1956, having its registered office at “GIRNAR” 21, Govind Marg, Moti Doongari Road, Dharam Singh Circle, Jaipur-302004, Rajasthan (hereinafter referred to as “Company”, which term may include, as the context may require, its affiliates, successors and assigns). Customer acknowledges that Company and its affiliates own and operate several online auto classified services portals including without limitation www.gaadi.com, www.cardekho.com and mobile applications thereof (collectively referred to as “Portals”).

"Assured Certified Cars" means such used/pre-owned motor vehicles, which are certified by the Company and bears a valid Assured certified tag and listed for sale by Dealer on the Portals under Assured Classified Section.

These Terms and Conditions apply to Assured Certified Cars purchased by Customers from Dealers under the Assured Programme as offered by the Company. Under Insurance Services, every Assured Certified Car will be accompanied by “Third Party Insurance Certificate” at no extra cost to the Customer, subject to following Terms and Conditions.

PERIOD OF COVERAGE

Third-party Insurance Certificate will be valid for a period of sixty (60) days from the date of purchase of Assured Certified Car by Customer from respective Dealer.

TERMS AND CONDITIONS

  • a. In case the Customer is not interested to avail Insurance Services and wants to purchase a comprehensive insurance, Customer shall intimate the Dealer in writing at the time of purchase of Assured Certified Car by Customer from respective Dealer. Insurance Services shall not be applicable and provided for such cases and Customer may purchase insurance policy of his/her choice at his/her own cost and expense.
  • b. Customer agrees that, if the existing insurance on respective Assured Certified Car is already valid for more than sixty (60) days from the date of purchase of Assured Certified Car by Customer from respective Dealer, Insurance Services shall not be applicable and provided for such cases.
  • c. Customer understands and agrees that Company and/or Dealer shall not be responsible or liable in any manner for any claim/liability/challan/fine/penalty/loss arising due to use of vehicle without a valid and effective insurance.
  • d. Safe custody of the physical copy of the third-party insurance Certificate is Customer’s sole responsibility and the Company and/or the Dealer shall not be responsible or liable in any manner if the physical copy of the third-party insurance Certificate is misplaced, damaged or lost. Company and/or the Dealer shall also be not responsible to provide a duplicate copy of the Third-party insurance Certificate.

OTHER TERMS

  • a. Company reserves the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change/cancel or vary these Terms & Conditions at its sole discretion.
  • b. These Terms and Conditions shall always be binding on the Customer.
  • c. The responsibility to provide complete, authentic & valid documentation and information, as required for availing the Insurance Services, is the sole responsibility of Customer. Customer understands and agrees that Company and/or Dealer shall be at liberty to refuse, without any responsibility or liability in any manner, provision of Insurance Services in case of inability/refusal to submit complete/correct documentation and/or information as per satisfaction of Company.
  • d. Customer agrees that provision of Insurance Services is only on commercially reasonable and best effort basis and subject to various factors beyond control of Company/Dealer, to support Customer with third party insurance for initial sixty days strictly as per the mentioned scope. Company shall not be responsible or liable in any manner for any events or circumstances beyond the mentioned scope or inability to provide Insurance Services for reasons not attributable to Company.
  • e. The decision of Company with regard to applicability of Insurance Services in relation to a particular vehicle and/or Customer shall be final, binding and non-challengeable.
  • f. All disputes relating to or arising out of these Terms and Conditions shall be subject to laws of India and the courts of Jaipur, Rajasthan India shall have exclusive jurisdiction. Customer understands and agrees that Assured Certified Car has been purchased by Customer from Dealer and it is clarified that in the event of any dispute, Customers sole and exclusive remedy shall be against the Dealer for concerning Assured Certified Car and related Insurance Services. Company’s role is solely limited to facilitate provision of Insurance Services through the Dealer, as per Terms and Conditions.
  • g.If any terms of this Terms and Conditions conflict with any other terms and conditions/document/electronic record, this Terms and Conditions shall prevail and supersede, to the extent of such conflict or inconsistency.


Assured Programme (7 Days Money Back) – Terms and Conditions


These terms and conditions of Assured Programme - 7 Days Money Back (hereinafter referred to as “Terms and Conditions”) is an electronic record in the form of electronic contract in terms of Information Technology Act, 2000 (as amended from time to time) and rules framed thereunder. Further, this electronic record is generated by a computer system and does not require any physical or digital signature or seal.

"Assured Certified Cars" means such used/pre-owned motor vehicles, which are certified by Company and bears a valid Assured certified tag and listed for sale by Dealer on GAPL’s Portals under Assured Classified Section.

These Terms and Conditions apply to Assured Certified Cars purchased by Customers from Dealers under the Assured Programme as offered by the Company, accompanied by a Company’s 7 Days Money Back Certificate. Under 7 Days Money Back, each Assured Certified Car will be protected for a period of 7 days from the date of purchase of Assured Certified Car by Customer from the Dealer, with 100% refund of amount paid by Customer to Dealer for the purchase of Assured Certified Car, subject to the following Terms and Conditions:

PERIOD OF COVERAGE

The 7 Days Money Back Certificate will be valid for a period of seven (7) days from the date of purchase of Assured Certified Car by Customer from the Dealer.

WHAT IS 7 DAYS MONEY BACK

100% Refund – In the event Customer have any doubts about the Assured Certified Car purchased from a Dealer under the Assured Programme, Customer has an option to return the Assured Certified Car to Dealer within a period of 7 days from the date of purchase of Assured Certified Car by Customer from the Dealer and ask for 100% refund from the Dealer, of amount paid by Customer to Dealer for the purchase of Assured Certified Car.

7 DAYS MONEY BACK TERMS AND CONDITIONS

  • a. A return request should be placed by Customer to Dealer within seven days from the date of purchase of car by Customer from Dealer.
  • b. This unique offering is applicable only for Assured Certified Cars with a valid Assured certified tag.
  • c. Assured Certified Car during the 7 Days Money Back period should not undergo any replacement of vehicle parts or accessories/ refurbishment without explicit written permission of Company.
  • d. Assured Certified Car should not have run more than 500 Kms as determined from the difference of odometer reading at the time of handover as captured in the final inspection report and the odometer reading at time of return of the car by Customer to Dealer.
  • e. Assured Certified Car should not be used to commit a crime or involved in any unlawful or illegal activities.
  • f. Assured Certified Car should not be involved in or liable to be involved in a legal case during the 7 Days Money Back period.
  • g. Assured Certified Car should not be involved in any accident or any damage that results from hard driving due to race, rally, misuse, abuse, hire, fire, flooding or any other natural calamity.
  • h. 7 Days Money Back shall not be applicable in case of loss or damage caused by negligence, fraudulent or malfeasant acts or omissions or wilful misconduct, corrosion, use of poor quality / adulterated fuel, coolant or lubricating oil, intrusion of foreign or deleterious matter, freezing, abuse by continued use of car after a fault has become evident or any intentional damage caused to the car, driven even after noticing a fault or defect resulting in consequential damage and loss.
  • i. 7 Days Money Back shall not be applicable in-case odometer is not maintained in working order or disconnected or tampered, post-delivery of the car or any part of car has been tampered or altered with intentionally.
  • j. Company may, at its sole discretion and subject to inspection, allow 7 Days Money Back in cases of cars with minor damages, repairs, scratches/ dents and part replacement, post deductions of cost and expenses as it may deem fit.
  • k. Customer is required to furnish all the original documents provided at time of sale, including but not limited to Original Registration Certificate, Insurance, all original and duplicate keys, vehicle transfer documents, payment proofs, delivery challan, all service records along with copy of 7 Days Money Back certificate to Dealer. 7 Days Money Back shall not be applicable if all the original documents/information as required by Dealer are not furnished or any of the document or information are found to be forged or fake.
  • l. RTO transfer process will be initiated by the Dealer post completion of 7 Days Money Back period i.e. post seven days from date of purchase of Assured Certified Car by Dealer to Customer. In case, the Customer demands RTO transfer during first seven days of purchase, then 7 Days Money Back shall not be applicable.
  • m. Third party insurance cost shall be borne by the Customer during the first seven days of purchase of car, where there is no insurance or insurance is in a lapse state at the time of purchase of car.

OTHER TERMS

  • a. All disputes relating to or arising out of these Terms and Conditions shall be subject to laws of India and the courts of Jaipur, Rajasthan India shall have exclusive jurisdiction. It is clarified that in the event of any dispute, Customers sole and exclusive remedy shall be against the respective Dealer for refund of any amount paid by the Customer to respective Dealer for concerning Assured Certified Car and Company shall not be responsible or liable in any manner to the Customer in this regard.
  • b. Company reserves the right (at its sole and absolute discretion), at any time, without prior notice and without assigning any reason thereof, to add/alter/modify/change/cancel/withdraw/vary these Terms & Conditions.
  • c. The decision of Company with regard to applicability of 7 Days Money Back in relation to a particular vehicle and/or Customer shall be final, binding and non-challengeable.
  • d. If any terms of this Terms and Conditions conflict with any other terms and conditions/document/electronic record, this Terms and Conditions shall prevail and supersede, to the extent of such conflict or inconsistency.


Assured Programme (RC Transfer Support Services) - Terms & Conditions


These terms and conditions of Assured Programme – RC Transfer Support Services (hereinafter referred to as “Terms and Conditions”) is an electronic record in the form of electronic contract in terms of Information Technology Act, 2000 (as amended from time to time) and rules framed thereunder. Further, this electronic record is generated by a computer system and does not require any physical or digital signature or seal.

“Company” means Girnarsoft Automobiles Private Limited, a company incorporated under the provisions of the Companies Act, 1956, having its registered office at “GIRNAR” 21, Govind Marg, Moti Doongari Road, Dharam Singh Circle, Jaipur-302004, Rajasthan (hereinafter referred to as “Company”, which term may include, as the context may require, its affiliates, successors and assigns). These Terms and Conditions apply to Assured Certified Cars purchased by Customers from Dealer under the Assured Programme as offered by the Company. Under RC Transfer Support Services, requisite support will be provided to Customer for completion of formalities regarding transfer of registration certificate (“RC”) of Assured Certified Cars in the name of Customer, subject to the Terms and Conditions.

TERMS AND CONDITIONS

  • a. RC Transfer Support Services: Subject to Customer, registered owner and all concerning parties to sale-purchase transaction of Assured Certified Car, extending necessary co-operation and support including personal appearances (RTO Party Peshi), and provision of requisite original and duly executed documents, commercially reasonable efforts will be exercised to oversee and coordinate for transfer of registration certificate of Assured Certified Car in the name of Customer within a period of 180 days from the date of handover of possession of Assured Certified Car to Customer by Dealer. Customer understands and agrees that registration certificate transfer process may take longer time owing to multiple factors which are beyond the control of Company/Dealer and Company/Dealer shall not be responsible or liable for same.
  • b. RC Transfer Support Services will be provided at no additional cost, if the transfer of vehicle is within the same city of previous registration. For example: RC Transfer Support Services for a DL no. registered vehicle will be provided to the Customer without any additional cost, if the Customer provides a valid address proof required by local RTO of New Delhi.
  • c. In case the transfer is outside the state of previous registration, charges will be extra applicable as per the prevailing rates payable by Customer to Dealer. The charges will have to be borne by the Customer, However, the Company will support and facilitate the customer with the documentation and the transfer formalities.
  • d. In case the Customer opts for loan, RC Transfer Support Services will not be applicable and provided. Requisite charges will be deducted by the respective bank and RC transfer is done by the bank only.
  • e. RC Transfer Support Services will be initiated only after completion of 7 Days money back period i.e., 8th day of purchase of Assured Certified Car by Customer from respective Dealer.
  • f. If the Customer doesn’t want to wait for 7 days and wants to get RC transfer process initiated immediately after purchase, Customer can opt out of 7 Day money back scheme by giving requisite confirmation and undertaking to the Dealer, and RC Transfer Support Services will be initiated immediately.

OTHER TERMS

  • a. Company reserves the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change/cancel or vary these Terms & Conditions at its sole discretion.
  • b. These Terms and Conditions shall always be binding on the Customer.
  • c. The responsibility to provide complete, authentic & valid documentation and information, as required for availing the Insurance Services, is the sole responsibility of Customer. Customer understands and agrees that Company and/or Dealer shall be at liberty to refuse, without any responsibility or liability in any manner, provision of RC Transfer Support Services in case of inability/refusal to submit complete/correct documentation and/or information as per satisfaction of Company.
  • d. Customer agrees that provision of RC Transfer Support Services is only on commercially reasonable and best effort basis and subject to various factors beyond control of Company/Dealer, to support Customer for transferring RC in his/her name, strictly as per the mentioned scope. Company shall not be responsible or liable in any manner for any events or circumstances beyond the mentioned scope or inability to provide RC Transfer Support Services for reasons not attributable to Company or completion of RC transfer process. Customer shall be solely responsible and liable for completion of RC transfer process.
  • e. The decision of Company with regard to applicability of RC Transfer Support Services in relation to a particular vehicle and/or Customer shall be final, binding and non-challengeable.
  • f. All disputes relating to or arising out of these Terms and Conditions shall be subject to laws of India and the courts of Jaipur, Rajasthan India shall have exclusive jurisdiction. Customer understands and agrees that Assured Certified Cars has been purchased by Customer from the Dealer and it is clarified that in the event of any dispute, Customers sole and exclusive remedy shall be against the Dealer for concerning Assured Certified Car and related RC Transfer Support Services. Company’s role is solely limited to facilitate provision of RC Transfer Support Services through the Dealer, as per Terms and Conditions.
  • g. If any terms of this Terms and Conditions conflict with any other terms and conditions/document/electronic record, this Terms and Conditions shall prevail and supersede, to the extent of such conflict or inconsistency.
